PFAS TSCA Section 8(a)(7) Reporting and Recordkeeping Requirements
Are You Ready?
Because of their prolific application and use, PFAS can now be detected in the environment, including in drinking water, surface waters, animals and even in people.
Because of the risks from exposure to certain PFAS, US EPA has implemented its PFAS Strategic Roadmap, which consists of regulatory actions that will affect many businesses.
Among these actions is the promulgation of the TSCA Section 8(a)(7) Reporting and Recordkeeping Requirements. Businesses are required to report materials and products that contain PFAS that they either manufactured or imported since 2011.
The submission period will start on July 11, 2025.
The reports are due on:
- January 22, 2026, for reporters submitting pursuant to 40 CFR §§ 705.15 (entities without exemptions) and 705.18(b) (research and development)
or
- July 11, 2026, for reporters submitting exclusively pursuant to § 705.18(a) (article importers).
The report will be required to include such information as:
- The Category of Use
- Production Volumes
- Resulting Byproducts
- Information on the Environmental and Health Effects
- Worker Exposure Potential
- Disposal Method
TSCA Section 8(a)(7)reporting will be submitted online through the US EPA Central Data Exchange (CDX), the Agency’s electronic reporting site.
