NYSDWC Announces Future of Drinking Water Standards

On March 10, 2022, the New York State Drinking Water Council (NYSDWC) introduced proposed amendments to future Emerging Contaminant (EC) monitoring of Public Water Supply systems. Of the 23 EC-listed PFAS compounds, identified by EPA Method 533, four (4) additional EC-listed PFAS compounds are being considered for MCL development. They are:

• PFHxS
• PFHpA
• PFNA
• PFDA

This determination made to include the four (4) proposed EC-listed PFAS compounds is based on having:

1) Longer half-lives & lower effect levels, compared to other PFAS;
2) Similar half-lives and toxic effects as PFOA and PFOS;
3) Regulated by other states already;
4) Documented presence in existing drinking water supplies; and,
5) Been identifiable utilizing existing USEPA methods for testing drinking water (e.g., USEPA Method 533)

Following the toxicologic review for each of these compounds a 10 ppt individual MCL was proposed. Although the timeline was still being finalized this recommendation will likely be introduced to NYSDOH in April 2022 with a goal of drafting regulations in June 2022 and issuing final regulations by early fall of this year.
