NYSDEC Issues Updated SPDES Multi-Sector General Permit
The NYSDEC has recently issued an updated SPDES Multi-Sector General Permit (MSGP) for Stormwater Discharges Associated with Industrial Activity (GP-0-23-001), which became effective as of March 8, 2023 and which will provide coverage to these industrial activities through March 7, 2028. The MSGP is available on the NYSDEC website at dec.ny.gov/docs/water_pdf/gp023001final03082023.pdf, and replaces the previous MSGP (GP-0-17-004) under which your facility previously gained coverage in 2018 or later.
As part of GP-0-23-001, facilities previously covered under GP-0-17-004 will need to submit a Notice of Intent (NOI) to gain coverage under the new permit within 90 calendar days permit issuance (by June 6, 2023) and prepare and implement a revised Stormwater Pollution Prevention (SWPP) Plan complying with the new MSGP within 120 days of permit issuance (by July 6, 2023). The most notable change to the permit is the inclusion of new requirements related to New York’s Climate Leadership and Community Protection Act (CLCPA), however other changes/updates are also included throughout the nearly 200 page document.
