PERM 75
PERM 75 is a Consolidated Application and Permit for Highway Work and Use & Occupancy for Fiber Optic Facilities and Supporting Infrastructure. As of November 23, 2020, the New York State Department of Transportation (NYSDOT) requires all PERM 75 applications for all eleven NYSDOT regions to be submitted through the Centralized Intake Portal.
Application Requirements:
- All applications must include a survey prepared by a licensed Land Surveyor, certified to NYSDOT. Any applications that do not delineate the ROW boundary by a licensed Land Surveyor will be returned to the permittee as incomplete.

- The PERM 75 Use & Occupancy (U&O) permit fee is a month-to-month license that automatically renews. The PERM 75 U&O fee is based on the fiber optic installation and the Highway Work Permit will cover all proposed work. In some circumstances, a secondary (non-fiber optic) U&O permit will be required. This would include multifamily and commercial utility crossings; utility occupancies of unimproved state property; and longitudinal occupancies of freeway rights of way. The annual fee for the U&O is assessed by the Office of Right of Way, using the department’s fee schedule.
- The PERM 75 only allows for one applicant for the Highway Work Permit and another for the Use and Occupancy Permit. Future revisions to the PERM 75 application will add additional spaces for multiple permittees.
